A Tariff Rebuke and Supreme Failure

While the Supreme Court’s Decision on Tariffs is in line with the outcome we anticipated what I didn’t expect are the rambling narratives, the unholy bias of congenitally embedded ignorance which is why I believe Supreme Court Justice may have reached the point where a detailed performance review may be required to determine if their scope of powers is in desperate need of review most particularly in the case where litigation is deliberately promulgated for the express purpose of using the Senior Court to affect policy. Frankly, it would have been a far better outcome had the Court decided not to hear the case. As it is what they’ve done is to scatter dysfunction to every corner of the constitutional compass. Unintended or as foray into a yet to be defined form of judicial brilliance the fact is they’ve caused a seismic rift in Foreign Policy, International Relations, the Nation’s Economic Standing, Financial Markets, Presidential Powers, Separation of Powers, Fiscal Order and I’m sure there are more but this schedule should do nicely, for now.

The key component of the Prevailing Opinion appears to rest upon silent ambiguities, the so-called constitutional script known as “delegated authority” and the Courts conclusion that there is no provision within the International Emergency Economic Powers Act (IEEPA) that either articulates, conveys or affirms to the President such authority. Over the years Congress has made personal fortunes for many of its Members and Supporting Cast(s) without every passing a law that either entitles their action or prohibits any of them; you might even state it more clearly by stating that:

“Congress hereafter delegates unto itself unrestricted authority to do whatever whenever it chooses to do so.”

While at first blush this response may appear to be an indictment of the Court’s effort when in all honesty I merely intend to illustrate the dangers this Country is forced into when painfully ignorant Individuals are given unchecked power. In this case, the Chief Justice has led the charge in an effort to expose just how much time and energy is wasted in the attempt to appear, as earnestly as possible, to have done something without having anything of merit to show for it.

Justice Thomas, to his credit, managed to land on many of the more appropriate points while Chief Justice Roberts success, at best, was to amass the more arcane citations perhaps in an attempt to conceal the more relevant points of order most of which have absolutely nothing to do with a breach in Constitutional order.

President Trumps use of Tariffs is on the order of the profound, both as a tool for economic revitalization and as a “Big Stick” in the battlefield of Foreign Policy; this type and level of efficiency hasn’t been seen since the Barbary Wars. True, there is a legitimate fear that a favorable ruling brings with it the risk that a future President, one with no seasoned and proven expertise, would use “IEEPA” inappropriately or in a self-serving way. Examples being funding operations (such as the bombing of aspirin factories) in order to redirect public attention away from personal scandal, funding of personal vice, pollical assault, depositing funds onto the tarmac of a foreign airbases (funding Payoffs to foreign officials in exchange for their silence) and so on.

Examples of other material facts the Court fails to consider:

  •  A key Article II Power conveyed to the President is the authority to conduct Foreign Affairs. Integral to the efficacy of said authority and the measure of its success, undoubtably, is the achieved level of safety and economic security of the Nation and its People. On this subject alone the Court is both deaf and mute and yet on the subject of “Delegated Authority” you will find the Federalist Papers saturated with commentary by both Hamilton and Madison on the importance of delegated (Presidential) authority. Further,
  • Prior to the implementation of the blight identified as Federal Income Tax (16th Amendment) Tariffs were an effective tool for generating revenue and deliberate as a protective measure for the nascent sectors of the U.S. Economy. The benefit then, as it is today, is no less critical for recovering the disemboweled engine of the U.S. economy and its future. It is also the case that the Global Banking Systems use of a Fiat Monetary System has allowed governments to amass uncontrollable levels of debt, the U.S. alone has nearly $37 Trillion in debt while the E.U. and China are even larger. If the U.S. is to fully recover this massive debt-load will need to be addressed until then any one of the three financial blocks failures’ can knock out the whole.

This massive Debt Load and the fact that Congress seems perfectly satisfied with doing         nothing about it or, as in the case of the Court, doing everything possible to keep
someone from doing something about become the foundational cause compelling both         the procuring force and the inertial cure, i.e., “Delegated Authority.”

  • Think of the Trillions of Dollars in Trade that cross the Boarders into the U.S. all the while taking advantage of the infrastructure and the marketplace this Nation provides, at no cost. Now then add to it the Trillions of Dollars in Natural Resources (Oil, Natural Gas, Minerals etc.) that this Nation auctions off annually at a fraction of their worth. The combined transactional worth of these resources are measured in multiple Trillions of Dollars per year and lost, annually, due to the incompetence of a national bureaucracy.
  • The monumental failure of the Courts dominant opinion lays squarely within the scope of its judicial authority and which manages to suffocate one of the single greatest components of this Nations Sovereign Authority: The Fortitude Offered by a Unified Force the precedence of which is the simplest and most fertile rule of all: The Rationale of Sound Reasoning. The mindlessness of the Court mirrors the ineptness of Congress along with the ease with which the Public has been dupped into believing there’s something dreadfully wicked about what Trump is attempting to do.

“When ignorance becomes the reference source for disciplined guidance then you should expect to find yourself caged by your Guide and starved by their ignorance!”

  • The question in search of a response is this: How influential, how formidably effective is a President of the United States who is forced to negotiate from a position of weakness?

One quick sidebar which is on the subject of inflationary forces due to Tariffs:

  • As I’ve written extensively on this issue many will be familiar with these perspectives however a quick comment on the topic may be in order as some may be tempted to believe that given the Courts response a sudden drop in price levels will soon follow.
  • Whatever your calculated perception of Tarriff may be they need to be refreshed because most Folks perceptions are fantastical illusions. The Public has been seduced into believing the Tariffs are a cost of purchase when, in truth, they are the price a Seller/Manufacture should pay for the privilege of having access to the marketplace where ready-buyers already readily exist. Do you (really) think McDonalds gives access to its marketplace (for McDonalds product) at no cost to its Operators? Really? Think again, McDonalds charges a Franchise Fee to a willing Individual who wants access to a marketplace already existing with willing Buyers willing to buy and they’re glad to do it. Anyone that tells you that Tariffs are a burden on the economic system is illiterate and if you believe them then you are an entitlement snob. Sorry, but it’s true. Face it, this economic engine that was once so powerful it was able to fuel a global economic emancipation the likes of which had never existed.
  • On the subject of inflationary forces spawned by tariffs I will argue that whatever level there might have been was or could be resolved by taking advantage of deliberate fluctuations in currency valuation Example: The U.S. Dollars when compared to the Euro, since December of 2024, has dropped 14.4%. Similar advantages have occurred in the case of the Chinese Yuan as well as in other currency arbitrage platforms.
  • Lastly, the subject (Tariffs) has many facets to it and certainly worthy of a good and thorough discussion but neither time nor space afford me the privilege accordingly I’m going to close this portion of the discussion while trusting that you are certain I am able to mount a convincing argument on the matter and in support of the following: There exists a Force, some call it the Deep State, others the Elite, Globalists, The Bilderberg, Trilaterals etc.
    Oh yes indeed this predatory Force exists and they are bent on defeating Trump’s movement simply because he represents the most potent force yet assembled capable of taking them down. The Globalist’s ideal, in the simplest of terms, is bent on forcing the return of a cooperative form of Feudalism and they are not about to go down without a fight. How serious are they? Very! Take a look at the Petitioners including those in the Amicus Brief and you will find a list of those who are a part of the Globalists regime or Stooges feeding off them.

Much of this Nation’s march through time reveals a history marred by the bias of predatory interests the consequence of which has been that little to no attention has been given to the preservation of its sovereign interests. The cycle of manufactured crisis where a threat leads to war, social disfunction to social disfigurement, economic deprivation to economic desperation and still the ambiguity of lethargy remains. Another example of these abuses are Trade Policies dating back to the end of WWII; deliberately structured to protect Europe while they dugout from the devastating effects of the War still, just prior to Trumps restructuring, in effect.

Trumps use of the IEEPA was a strategic move, expected to be short lived, but effective in accelerating what was needed. Trump understands that in order to create economic recovery the Nation needed a tool (a weapon) for funding it. The Courts actions will not stop Trump from his plan to drag this Country out of the downward slide it seemingly prefers. How effective will he be?

The American Public has, for once, a very clear picture of what the two futures look like: The dystopian hopelessness offered by the Fascist Dems or NOT; in nine months you will have your answer.
